Visitor Terms

These terms are for customers and suppliers of a business that uses TrackYourShelves, not for the business itself. If you run a business on TrackYourShelves, the Terms of Service are yours.

1. The short version

You are booking with, buying from, or supplying a business. That business is who you are dealing with. TrackYourShelves L.L.C. ("we") makes the software the page runs on, nothing more.

We are not a party to whatever you agree with them. We do not set their prices, their hours, their cancellation policy, their refund policy, or what they sell. We do not decide whether they turn up. Those are all theirs, and questions about any of them go to them.

2. When these apply

They apply when you use a page we operate on a business's behalf: a booking page, an online store, a customer or supplier portal, or a claim form. They apply whether or not the page carries our name, and they apply alongside (never instead of) whatever terms, policies or agreement that business has with you. Where the two differ about the thing you are buying or booking, theirs controls.

3. What we ask of you

Use the page for what it is for. Specifically, do not:

  • book, order or submit anything in somebody else's name, or using contact details that are not yours to use;
  • try to reach information belonging to another customer, another supplier, or another business, including by altering links, codes or identifiers;
  • attempt to break, overload, scrape at scale, probe or circumvent the page or the systems behind it, or work around a limit, a block or a security control;
  • upload anything unlawful, or anything containing malware; or
  • use an automated tool to hold, resell or monopolise availability.

We may block access that does any of these. A business can also refuse your booking or order under its own rules, which is their decision and not ours.

4. Your information

What you enter (your name, contact details, and whatever the business asks you for) belongs to the business you are dealing with. They decide what to collect and why. We hold and process it on their instructions, as their service provider, to run the page and send the messages it sends.

This matters for a practical reason: if you want your details corrected or deleted, or want to know what is held about you, the business is who can answer. Ask them first. Our Privacy Policy explains what we do as a processor, and we will help a business meet a request you make of them.

Messages about your booking or order (a confirmation, a reminder, a receipt) are sent because you made it. Marketing emails and text messages are separate, are only sent if you asked for them, and you can stop them at any time.

5. Payments

Where a page takes a payment, the money goes to the business, not to us. They are the merchant of record. Card details are handled by the payment processor and are not stored by us.

Refunds, deposits, cancellation charges and disputes about any of them are between you and the business, under their policy. We cannot issue a refund on their behalf and will not pretend otherwise.

6. No warranty from us to you

The page is provided as it is. We do not promise you that it will be available without interruption, that the times, prices or stock it shows are accurate, or that it is free of error. The information on it comes from the business and is theirs to keep right.

Nothing here limits any right you have against the business you are dealing with, or any right you have that cannot be limited under the law that applies to you.

7. Our liability to you

To the fullest extent the law allows, we are not liable to you for the acts or omissions of the business you are dealing with, including a booking they do not honour, goods they do not ship, a service they do not perform, or a refund they do not give.

Some jurisdictions do not allow certain exclusions. Where that is true for you, this section applies only as far as the law permits, and nothing in it removes a right you cannot waive.

8. Changes

We may update this document. The version that applies is the one published here when you use the page.

9. Contact

For anything about your booking, order, payment, refund or personal details, contact the business. They hold the record and they make the decisions. Their details are on the page you came from.
